1. The owners of the YOGi FUN brand, the owners of the website www.yogi-fun.com, sell yoga games for children and family toys through the company’s website, as well as through emails sent to customers who have subscribed to the mailing list. Sales are made both through the website and by phone.

3. In this document, the use of the feminine form also includes the masculine form.

4. Anyone placing an order and/or making a purchase through the website declares that by performing the action, she has read this policy, agrees to all its terms and conditions, and will have no claim and/or demand and/or suit against the website and/or the company and/or the site management and/or any of its employees or representatives in connection with the terms of this policy.

5. Use of the website, joining the mailing list, and/or purchasing a product offered for sale by the website constitutes the customer’s consent to accept and act according to this policy. Therefore, anyone who does not agree with any of its terms is requested not to use the website or subscribe to the mailing list.

6. The website serves as a virtual store for the sale of yoga games for children. It is owned and operated by the company.

7. Questions for the company’s customer service can be sent through the “Contact Us” page on the website.

8. This policy is the legal basis for orders and website browsing, and it alone regulates the relationship between the company and any visitor and/or customer who places an order through the website.

9. The company reserves the right to change the terms of this policy from time to time at its sole discretion, without prior notice.

10. The company’s computer records regarding actions carried out through the website will serve as prima facie evidence of the correctness of those actions.

11. Product images displayed on the website are for illustration purposes only and are not binding on the website management. It is agreed and clarified that the company will make every effort to present its customers with images that are as accurate as possible.

12. The company does not guarantee to maintain stock of all models whose images appear on the website.

13. The company makes every effort to ensure that the information presented on the website is complete and accurate. However, unintentional errors or inaccuracies may occur, and the company will not bear any responsibility arising from or related to them.

14. All prices on the website appear on the product pages and are listed in New Israeli Shekels (NIS). Prices include VAT, if applicable, and do not include shipping costs unless otherwise stated.

15. The website management may update product prices and shipping rates from time to time without prior notice. The valid price for an order is the price listed at the time the order process is completed (including credit card details submission). If prices are updated before the order is completed, the customer will be charged according to the updated prices.

16. The website management may offer promotions, benefits, and discounts on the website. It may cancel, replace, or modify these at any time without prior notice.

17. When the shopping cart is updated, the company reserves the right to send a reminder to the customer about the abandoned cart (a shopping cart where the purchase process was not completed), by sending an email to the address provided.

18. When registering on the website, there may be an option to subscribe to the company’s official newsletters. If the customer wishes to unsubscribe after registering, she may easily do so via a link that appears in the received email. It is the customer’s responsibility to ensure she has unsubscribed from the desired list.

19. Promotional vouchers and discount coupons apply to all items on the website except items already on sale. The specific terms for each coupon or promotion are detailed at the end of this document.

Orders and Purchases on the Website

1. To purchase a product through the website, select the desired product and add it to the shopping cart. To proceed with the purchase, fill in details such as name, address, email address, phone number, and credit card number.

2. To ensure the order is processed efficiently and without issues, all required details must be filled in accurately. If incorrect details are provided, the company cannot guarantee that the products will reach their destination. In the event that products are returned to the company due to incorrect details, the customer will be charged for shipping and handling fees. Customers must ensure that all information provided is accurate and up to date.

3. The website management will use the customer’s personal details only in accordance with the website’s privacy policy, which constitutes an integral part of these terms and conditions.

4. Upon receipt of the order, the credit card details will be verified. Only after the order is approved by the credit card companies will the order be confirmed, and the product shipped. The customer will be charged for the product through the credit card after placing the order.

5. The order details as entered by the customer in the order form, along with the transaction record in the company’s systems, will serve as final proof of the accuracy of the process. For clarification, an automatic email confirmation does not serve as proof of order execution and does not bind the website. Only the record in the website’s systems will serve as conclusive evidence of the transaction.

6. If the transaction is not approved by the credit card company, the customer will receive an appropriate notice and will be required to provide an alternative payment method.

7. Order confirmation depends on the product being in stock in the company’s warehouse at the requested delivery time and/or order date. If the product is unavailable but still listed on the website, the company will not be obligated to sell it. The customer will not have any claim or demand regarding any direct or indirect damage caused by this. In such a case, the company will refund the amount paid (if paid) or cancel the charge (if processed). There may be situations where an item is displayed on the website but is out of stock; in such cases, the transaction will be canceled, and the customer will be refunded, with no further claims permitted.

8. Each customer may choose a shipping destination by updating the desired address in the order form. The last updated address will be saved in the company’s records as the customer’s delivery destination.

9. The company reserves the right, at its sole discretion, not to approve a customer’s order for any reason, including the following:

   • If false details were intentionally provided during registration.

   • If actions or omissions have been made that harm or may harm the website, its management, third parties, customers, employees, or suppliers.

   • If the website’s services were used to perform an act that appears illegal under Israeli law or to enable, assist, or encourage such an act.

   • If the terms of this agreement or any other binding document related to the website have been violated.

   • If there is an outstanding debt to the company or its affiliates that has not been paid.

   • If the customer’s credit card has been blocked or restricted in any way.

10. After payment details are entered on the payment page, an email confirmation will be sent confirming that the order details were received. This confirmation does not obligate the website to supply the products and only indicates that the order was received by the system.

11. If the customer’s credit card is invalid, the credit card company does not honor the transaction, PayPal (or any other digital wallet service) does not approve the charge, or the item is out of stock, the website management will contact the customer to complete or cancel the transaction.

12. According to the website’s policy, gifts received during promotions are limited to one gift per customer.

Returns and Exchanges

1. “Cancellation of a transaction shall be in accordance with the Consumer Protection (Cancellation of a Transaction) Regulations, 2010, and the Consumer Protection Law, 1981.”

2. The purchaser (and not the recipient) may cancel the order under the following conditions. Any refund will be issued to the credit card used for the purchase only, in accordance with the credit card company’s processing timelines:

   • If the order is canceled before the product is shipped to the customer, no additional charges will apply, and the full payment, including shipping costs, will be refunded. Refunds will be made in accordance with applicable law.

   • If the transaction is canceled after the product has been shipped to the customer, a refund will be issued minus 5% of the purchase amount and the shipping cost. The refund will be provided only if the returned product is unused, undamaged, and in its original packaging, with all tags attached. If the product is returned in a condition that does not meet these terms, the purchaser will not be eligible for a refund (neither monetary nor credit).

   • The company reserves the sole right to determine the condition of returned products.

   • A product may be returned, unused and in its original packaging, within 14 days of receipt.

   • Eligibility for a refund is limited to up to one month from the date of purchase (via credit card or PayPal).

3. No refunds will be issued for items received as part of promotions, gifts, or items for which no monetary payment was made.

4. To return a product, the customer must ship it back to the company.

5. Direct debit (debit card) holders cannot be refunded to their card; instead, they will receive store credit in an equal amount for future use on the website.

6. In case of order cancellation as outlined above, the customer will be charged a cancellation fee not exceeding 5% of the product price or 100 NIS, whichever is lower.

7. For products purchased at a discount during a sale or promotion, if the customer requests store credit, the value of the credit will equal the original amount paid, without deduction.

8. Refunds are applicable only for items priced at 50 NIS or more.

Delivery and Shipping

1. Product deliveries to customers are carried out via postal services and within the delivery time frame promised at the time of sale.

2. The shipping fee amount will appear at the end of the checkout process, under the items selected for purchase, and will be charged at the time of order placement. In the case of installment payments, the shipping fee may be charged as part of the first payment.

3. The ability to place an order through the website is limited to areas covered by the Israel Postal Service delivery map. The company may, but is not obligated to, deliver to locations outside the designated service areas, subject to prior telephone coordination. Therefore, even if such an order is received and processed by the website’s system, the company will not be obligated to fulfill it.

4. The delivery times mentioned above do not apply to items that are out of stock.

5. The order will be delivered once the purchase process is completed, provided that the order was received within the valid transaction period as defined on the product page, that the customer has a valid credit card that can be charged in Israel, and that the credit card company has approved the transaction.

Company Responsibility

1. The company and/or the website management and/or anyone acting on their behalf shall not be held liable for any direct, indirect, consequential, or special damages caused to the user and/or customer and/or purchaser and/or any third party resulting from use or purchase through the website not in accordance with this policy—regardless of the cause of action—including loss of income and/or profit for any reason. In such cases, the company reserves the right to cancel the specific order.

2. Any typographical error in the description of an item will not obligate the company or the website management.

3. Product images on the website are for illustration purposes only. There may be differences between the images displayed and the actual items sold.

4. In any case, the company’s liability shall not exceed the value of the purchased product, nor include any indirect or consequential damages.

5. The company is not responsible for any use of its products that does not comply with the manufacturer’s and/or company’s instructions.

6. The website management will not be responsible for any delivery delays caused by circumstances beyond its control, such as malfunctions, delays, strikes, natural disasters, computer or telephone failures affecting the completion of purchases, or issues with email services.

7. The website management will make every effort to supply high-quality products within the promised timeframe. If a customer believes that a product purchased through the website is defective or unsatisfactory, they are encouraged to contact customer service, which will handle the matter as soon as possible.
